Uninsured / Under-Insured Motorist ServicesThe purpose of uninsured or underinsured motorist coverage (called UM or UIM insurance) is to protect ourselves in the event of an accident caused by a person who carries little or no auto insurance.  In the aftermath of an accident with an uninsured motorist, you must make a UIM claim with your own insurance company. 

The insurance company’s goal is to minimize expenses, which is opposite to your goal of getting full and fair compensation based on your UIM claim for your injuries following an accident involving an uninsured motorist. After all, you have paid insurance premiums for months, year, maybe decades without asking for anything in return. Now that you have been hurt by an unisured motorist, you are asking your insurance company to make good on their promise to pay.

It is not uncommon in UIM cases for the injured person’s insurance company to refuse to pay out on a UIM claim.  Or, if the insurance company offers to payout, the amount may initially be much less than the claimant deserves based upon the injuries suffered. 

In such a case, the UIM claim may become an insurance bad faith claim.  If your insurance company refuses to deal fairly with you while processing your claim, an experienced attorney may be able to bring a successful bad faith claim against the insurance company.  Bad faith on the part of an insurance company may include actions like failing to promptly and reasonably investigate the claim, unreasonably refusing to pay a valid claim, refusing to pay a claim in a timely manner, and offering an unreasonably low settlement.

For accident survivors, it can add insult to injury if their own insurance company refuses to pay a UIM claim, especially when the uninsured motorist insurance is the only source of funds to pay medical bills and lost wages.
